  • Terms And Conditions: This is an online only auction. All bidding will be taking place online. Buyers must register via www.landandauctions.com to be able to bid. Credit or debit card information is required and a $1.00 refundable authorization will be applied to make sure bidder is legitimate.

    Real Estate Auction begins on November 11th at 8:00 a.m. and will end at 5:30 p.m. November 15th, 2022. There will be a “soft close” meaning that 2 minutes prior to the end time, a timer will start and if any other bids are submitted within those 2 minutes, the clock restarts for another 2 minutes. This will continue on until no bids are submitted in the 2 minutes since the last bid.

    Personal Property Bidding Goes from October 24th-30th with lots beginning to close at 5:00pm. Personal Property Pickup will be November 2nd from 10:30am-6:30pm.

    Seller is motivated but the seller reserves the right to accept or reject the final bid price. Winning high bidder will be notified if the seller accepts or a notice will be put online during the auction to make all bidders aware that the seller approves of the bid price at that point.

    Buyer’s Premium: There will be a 3% buyer’s premium added on to the final bid of the Real Estate, and a 10% Buyer’s Premium on personal property purchases. Cash or check preferred on personal property items with a 4% fee for credit card transactions.

    Property sells as is with no financing or inspection contingencies and buyers should have made arrangements prior to bidding at this auction. It is highly recommended that each potential buyer take the time to personally inspect the property prior to auction. The Purchaser should be satisfied with the location and condition of the property, and all descriptions thereof, before bidding. All information contained in the brochure and all promotional materials, including, but not limited to, square footages, acreage, dimensions, maps, taxes, etc., was derived from court house and other records and are believed to be correct; however, neither the Seller nor the Auction Company makes any guarantee or warranty as to the accuracy or completeness of such information.

    Earnest money will be $10,000 made out to Town and Country Abstract and payment shall be in the form of business, personal, or cashiers check. Credit/Debit cards can be acceptable payment but a 4% charge will be added onto the final bid price. Money will be delivered to the Century 21 McKeown office at 2040 Silva Lane in Moberly Missouri the day after the bidding has ended and a standard real estate contract will be signed at that time. The balance of the purchase price is due at closing.

    Taxes will be prorated at closing at closing

    Sellers will provide title insurance in the amount of purchase price and give title by general warranty deed. Customary closing fees will apply to both the sellers and buyers.

    The Auction Company reserves the right to cancel, suspend, extend or reschedule an auction event or to make changes to the auction closing times in the event of any unforeseen technical or legal problems.

    Server & software technical issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Century 21 McKeown and Associates Inc. reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company providing the software nor the real estate and auction company shall be held responsible for a missed bid or the failure of the software to function properly for any reason.

    Email notifications will be sent to registered bidders with updated information as deemed necessary by Century 21 McKeown and Associates Inc.

  • Personal Property Auction Terms and Conditions

    All bidders must carefully consider and agree to the following terms and conditions before placing a bid. This is an ONLINE ONLY auction and bidding will take place solely online and all bidders register via the company website.

    1. A 10% Buyer's Premium will apply to all Online purchases. Additional 4% on all Credit Card transactions.

    2. Bidding will open October 24th, 2022 and begin to close October 30th at 5pm. This is a “soft close” auction. For definition of soft close, refer to item #9

    3. Following the conclusion of the auction the winning bidder will have emailed receipt. If you have not received an email the following day of auction close, please check SPAM/JUNK folder or call 660-651-2288. Cash or check can be paid for item(s) on the pick up day. If you are paying by check or cash and the item is not picked up & paid for at the specified time your credit card will be charged. Buyer agrees that under no circumstances will he/she initiate a chargeback on his/her credit card.

    4. Declined credit/debit card transactions will be re-attempted twice. After the 2nd attempt items will be considered forfeited and may be re-sold at our discretion.

    5. The winning bidder will be notified of their winning bid(s) and amount charged to their Credit Card via email. PLEASE NOTE: If you do not receive your email, please call the auctioneer at 660-651-2288 or email michaelc@c21mckeown.com

    6. All items must be picked up November 2nd 2022 from 10:30am-6:30pm at the property address only unless prior arrangements are made with agent/auctioneers. Any items left that have not been paid for and no notifications or arrangements are made with the auction company, a $25 per lot fee will be charged for hauling to our location facility. After 2 weeks of no contact or pickup, the items become property of the auction company and resold at our discretion

    7. Buyers are asked to bring a copy of email and/or proper picture ID or other form of identification

    8. All property is sold "AS IS", and ALL SALES ARE FINAL. Cunningham Auctions LLC/ Century 21 McKeown and Associates Inc. may attempt to describe the merchandise in advertising and on the Internet but makes no representations. In no event shall Cunningham Auctions or Century 21 McKeown be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. It is the Bidder's responsibility to determine condition, age, genuineness, value, or any other determinative factor. Auctioneer shall endeavor to describe in detail each item and any pertinent information about it. Auction company and agents and employees will not be responsible for any errors or omissions in the description of the merchandise. Bidder agrees that everything is sold "as is" and that they may not return any item they purchase. Century 21 McKeown and Associates and Cunningham Auctions is providing Internet bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly during the auction. Under no circumstances shall Bidder have any claim against Cunningham Auctions/Century 21 McKeown and Associates or anyone else if the Internet service fails to work correctly before or during the auction. Cunningham Auctions/Century 21 McKeown and Associates will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should verify high bid through online interface.

     

    9. This auction has an extended bidding or "Soft Close" feature. When a bid is submitted in the final minutes of the auction for a lot, the bidding for that lot will be extended for an additional two minutes. This will continue until there are no longer any bids submitted for that individual lot. (Online-Only Auctions Only)

    10. Buyers are responsible for supplying any materials, equipment, or assistance needed to properly move and pack all purchased items.

    11. Items not picked up by winning bidders at the given address and time (refer to item 6) will be forfeited and sold at the discretion of Cunningham Auctions.
